| 内容記述 | 「国際法と国内法の関係」に関する学説の長期的な展開過程を追跡し,その蓄積と今日的意義を明らかにする.なお,国別・法系別に論じる必要がありうることに配慮し,特に国際法と日本法の関係に焦点を当てる.I.では,実行を概観する.一貫性を維持しつつ現代的法現象にも対応するために,基礎概念の再検討が必要となることが確認される.II.では,いくつかの基礎概念に関する日本の学説展開の軌跡と蓄積とを跡付ける.その結果, (1)体系間関係, (2)国内的効力, (3)国内的序列, (4)直接適用可能性に関する理論の発展には連続性があり,それらの総合的に把握し再構成させうることが示される.III.では,包摂的理論枠組みの試論として「部分連結する多重サイクル」モデルを提示する.合わせて,(1)「多元的構成」の再考,(2)国内的効力概念の再定位,(3)国家責任論との関係の再検討,という今後の研究課題を提示する. This article traces the doctrinal developments on the relationship between international law and Japanese law back to the 19th century, and then clarifies its contemporary significance. Part I of the article identifies current practical difficulties surrounding the topic, arising from the accelerating globalization and transnationalization, and stresses the urgent need to review some of the traditional key concepts for solving these difficulties. Part II gives a long-term process analysis of the developments in Japan of doctrines on the relationship between international law and domestic law. The analysis confirms substantial issue linkage in continual flow of debates as well as plenitude of theoretical achievements during inter-war period. Part III attempts to show a comprehensive framework for the organic integration of related concepts. Finally, three specific solutions are proposed in response to practical demands. |
